Proposition 8 was heard by the US 9th Circuit Court of Appeals today.
Again, the anti gay-marriage side declined to call any witnesses except two. They admitted that there is no scientific, rational, logical, or evidence-based argument that Teh Gay harms society, heterosexual marriage, or the well-being of children in any way. Their central argument was that they didn't
need evidence. It was just bad and wrong. So there.
The judges seemed... spectacularly unconvinced.
The question now comes down to whether they will throw the case out for lack of standing, or actual render a ruling. If they throw the case out, gay marriage will become legal only in California, and there it will stay. If they decide to rule, gay marriage will become legal in Alaska, Arizona, California, Hawaii, Idaho, Montana, Nevada, Oregon, Washington, Guam, and the Mariana Islands, at which point it will be immediately appealed to the US Supreme Court, where its fate is still unknown.
