He should have hired the best lawyer possible to go against Nintendo.
We know how aggressive is Nintendo to protect its IPs. Two things can be true at the same time: you are totally right and the dude was REALLY dumb to represent himself, but it's also a huge idiocy that this sort of lawsuit is won by who has the most money rather than, you know, what the law actually says, and Nintendo is famously very litigious even in cases when there absolutely no illegal act being committed.
