Basically, unless MS changes some things, some stances, the Xbox One will fail. Secondly, the way they are looking, Gamestop won't be selling Xbox One games because why would they? Trade ins are Gamestop's bread & butter, and "one-time transfers" wouldn't make the risk worth selling a used game, much less buying one. Only hardcore MStards will be playing an Xbox One, unless they change their stances, and those MStards will all be claiming it's better, but they know better. Thirdly, being that I missed MS' press conference I don't know word for word what was said, but people are saying MS blamed 3rd party and Indie devs for several things, while Sony embraced them, this was not a last minute "let's one-up MS" as they had tons of newer up and coming devs on stage showing their games.

Because Microsoft seems to insist on shooting themselves in the foot with bad business practices, and Nintendo is content on releasing the exact stuff we expect from them, while Sony actually surprised people not only on the Squeenix front, but also with the price and specs compared to the Xboned.
Besides, it's E3; if you want serious opinions, wait until it's over and the hype has calmed down.

Honestly, I think one way MS could make their practices work is if they took a page from Apple's book. Apple has the Apple store to showcase their Mac Desktop Computers, Macbooks, iPads, iPods, iPhones, and official accessories, support, repair services, warranties, etc. etc.

I think if MS opened a Microsoft Store, showcasing select brands of PCs, Laptops, Tablets, Windows Phones, Xbox-line gaming consoles and games, AND have way to waive the transfer fee/one-time restriction they might pull it off. It'd be a gamble, however. They would have to spend money to make money, but good chance they might not break even just selling Phones and game discs, which would probably be their hottest merchandice.
